WPP sees China as second-largest market in 2-4 years (Reuters)

SHANGHAI (Reuters) ? WPP Llc (WPP.L), the world's largest advertising company, sees China overtaking Britain as its second biggest market in two to four years, its chief executive said on Sunday.

The company, which last week cut its 2011 outlook due to slowing growth in the United States and the euro zone debt crisis, has been making a string of small acquisitions and investments in China.

"I would say China should surpass the UK in about two to three, four years," Martin Sorrell said in an interview with Reuters.

WPP's revenue in China is about $1.1 billion, placing it as WPP's fourth largest market by revenue currently, Sorrell said.

The country is expected to surpass Germany, which is in third place at $1.3 billion in revenue, in 2012. WPP's largest market is the United States at $5 billion, followed by Britain at $2 billion.

"There are acquisitions here, there are some good companies here, but they are small-scale. And therefore the big growth opportunities for us are not so much acquisitions but organic growth," Sorrell said.

Sorrell, who founded WPP in 1985 and grew it into an advertising juggernaut to include ad agencies JWT and Ogilvy & Mather, said preliminary forecasts for the full-year indicated like-for-like revenue growth of 5 percent, compared with a previous forecast of 5.9 percent.

As an indication of the country's importance to the company, Sorrell is in Shanghai to co-launch the WPP School of Marketing and Communications on Monday.

The school will be part of the Shanghai Art & Design Academy and will seek to train students in marketing and communications in a three-year program.

Sorrell sees the venture not only as a good recruitment arena, but an opportunity to instill in potential employees an early sense of loyalty in an industry plagued by high turnover.

"One of the ways of trying to improve a firm-wide loyalty is through this thing, both for your existing people because it is another area that they can make a contribution to. But also the people you will be recruiting because you establish early relationships," Sorrell said, adding that finding talent in China was an issue.

Mexico: Resort town shoppers trapped by gunfight (AP)

CABO SAN LUCAS, Mexico ? Mexican officials say hundreds of people cowered for more than an hour at a shopping center in the resort town of Cabo San Lucas while security forces traded fire with gunmen outside and then searched for them in stores.

No injuries have been reported from Saturday afternoon's gunbattle, which did damage some cars and entrance doors. Police say they arrested two men suspected of being involved in an overnight attack near the center that killed a Mexican marine.

Authorities say the shooting at the Plaza Sendero shopping center erupted when marines, soldiers and police found armed men in the parking lot.

Police ordered shoppers to stay inside during the shooting and later search. People were allowed to leave an hour later.

How the major stock indexes fared Friday (AP)

A quiet day on Wall Street ended Friday with major stock indexes little changed after a big rally the day before. The Dow Jones industrial average closed out its fifth week of gains, its longest winning streak since January.

The Dow Jones industrial average rose 22.56, or 0.2 percent, to close at 12,231.11.

The S&P 500 rose 0.5, or less than 0.1 percent, to 1,285.09.

The Nasdaq composite fell 1.48, or 0.1 percent, to 2,737.15.

For the week:

The Dow is up 422.32, or 3.6 percent.

The S&P is up 46.84, or 3.8 percent.

The Nasdaq is up 99.69, or 3.8 percent.

For the year to date:

The Dow is up 653.60, or 5.6 percent.

The S&P 500 is up 27.45, or 2.2 percent.

The Nasdaq is up 84.28, or 3.2 percent.

There are countless satellites, long deactivated, orbiting the Earth in what amounts to a giant cemetery in the sky. DARPA's Phoenix program sees these piles of junk not as refuse, but as a resource just waiting to be harvested. The plan is to re-engineer existing technology, like robots used in remote surgery and advanced imaging systems found in off-shore drilling platforms, for the harsh environment of space. The resulting orbiter would operate on the deceased (with the owners approval, of course), salvaging what it could and stitching them together to create new functional satellites. (Try storming those gates angry mob!) DARPA is also looking into building tiny "satlets" which could simply be clipped to the antennas of deactivated satellites, breathing new life into them and saving a significant chunk of cash. Gaddafi son Mo'tassim captured alive: TV (Reuters)

CAIRO (Reuters) ? The son of deposed Libyan leader, Mo'tassim Gaddafi, has been captured alive in Sirte, fighters in the field have told the National Transitional Council, an official said on Thursday.

"Our information from the commanders in the field is that Mo'tassim Gaddafi has been captured alive in Sirte," National Transitional Council's information minister, Mahmoud Shammam, told Reuters.

Shammam said he could not independently verify the report.

Earlier, Al Jazeera and Al Arabiya had said Mo'tassim was captured. Al Arabiya said it would broadcast images of Mo'tassim after his capture.

Losses mean sleepless nights for John Paulson (Reuters)

NEW YORK (Reuters) ? Hedge fund heavyweight John Paulson said poor performance by his funds keeps him up at night, so the billionaire stock picker must be going sleepless a lot these days.

This year is quickly shaping up to be the worst of Paulson's decades-long career, with most of his portfolios in the red and the Advantage Plus fund off 47 percent through September.

Paulson, who shot to fame and fortune with a bet in 2007 that the housing market would crash, has been engaging in as much damage control as possible before a critical October 31 redemption deadline. Last week he held a call with investors, and on Thursday he spoke at a conference sponsored by the industry trade group Managed Funds Association.

As Paulson and two other prominent fund managers, Eric Mindich and Paul Singer, addressed an audience at the Pierre Hotel in midtown Manhattan, a handful of anti-Wall Street protesters gathered outside on Fifth Avenue chanting slogans aimed at the executives.

The panel discussion -- titled Challenges, Opportunities and What Keeps You Up at Night -- was off limits to the media and attendees were asked not to speak to reporters. But several chatted all the same, saying that when Paulson was asked the critical question, he replied that losing money and poor performance robs him of sleep.

"He was being very honest and earnest, not at all flip about this matter," said one attendee, who did not want to be identified.

Many of Paulson's funds have lost big this year as the money manager bet that the U.S. economy would revive sooner rather than later.

Outside the hotel, the protesters handed out fliers with Paulson's and Singer's pictures and chanted "Hey, Paulson, you can't hide, we can see your greedy side. Paul Singer, you can't hide, we can see your greedy side."

Paulson earned $5 billion last year, an industry record, on a successful bet on gold. He earned about $3 billion in 2007.

Since the protests against Wall Street started, Paulson's eye-popping paydays have made him a target.

But on Thursday, he slipped out of the Pierre Hotel nearly unnoticed, dashing out a side door into a waiting black vehicle that whisked him away.

Citi Q3 net rises, boosted by accounting gain (Reuters)

(Reuters) ? Citigroup Inc reported higher third-quarter earnings on Monday, helped by rising income from Asia and an accounting gain banks can take in turbulent markets.

Even stripping out the accounting gain, the results were better than some analysts had expected, and Citi shares rose as much as 3.8 percent in early trading. At mid-morning they were up 1.4 percent to $28.79.

Like its rivals, Citigroup was hit by the European debt crisis and the sluggish U.S. economy. Investment banking fees dropped, and its loan book fell 2 percent. Operating expenses rose, in part because of investments the bank is making to boost its business.

Citigroup's extensive overseas operations helped the bank during the quarter, particularly in Asia, where income from continuing operations at its consumer banking business rose 14 percent.

"The bets they're making in the international markets are paying off," said Michael Holland, founder of Holland & Co LLC in New York.

Citigroup, the third-largest U.S. bank by assets, reported net income of $3.77 billion, or $1.23 per share, up from $2.17 billion, or 72 cents per share, in the same quarter last year.

The third-quarter results included a pre-tax gain of $1.9 billion, or 39 cents per share after taxes, due to the bank's widening credit spreads during the quarter. When a bank's debt weakens relative to U.S. Treasuries, it can record an accounting gain because it could profit from buying back debt.

Excluding that gain, Citi earned $2.6 billion, or 84 cents per share.

Revenue at the bank's continuing securities and banking business fell 12 percent excluding the debt value adjustment, to $4.84 billion, hurt by declining underwriting and merger advisory fees.

JPMorgan Chase & Co also reported declines in investment banking fees when it reported third-quarter results last week. JPMorgan also reported an accounting gain identical to Citi's.

Overall operating expenses for Citigroup rose 8 percent from a year earlier. Operating expenses were $12.46 billion and have been hovering around that level since the fourth quarter of 2010. From the beginning of 2009 through the third quarter of 2010, quarterly operating expenses were typically closer to $11.9 billion.

It was not immediately clear if the quarterly earnings were comparable to analysts' average forecast of 81 cents per share, according to Thomson Reuters I/B/E/S. But several analysts said earnings of 84 cents per share excluding the accounting gain beat the Street.

Citi, which received three U.S. government rescues at the height of the financial crisis, is seeing its problem loan portfolio shrink.

Nonaccrual loans fell to $7.95 billion from $12.46 billion a year earlier.

The bank's share price has fallen about 40 percent this year, in line with declines for other large banks.

With Major League Baseball's World Series set to begin today, NJIT math professor Bruce Bukiet has once again analyzed the players most deserving of winning baseball's most important awards for the 2011 season. He also provides the probability of Texas Rangers and St. Louis Cardinals winning the World Series.

"Now that the Texas Rangers and St. Louis Cardinals have won their League Championships, the Texas Rangers have a 63 percent chance of winning the World Series although the National League Champion St. Louis Cardinals have the home field advantage."

At the season's start, Bukiet used his mathematical model to project the number of team wins (see: http://m.njit.edu/~bukiet/baseball/2011_season_predictions.htm). Last April, Bukiet's model selected five of the eight post-season winners. His analysis gave him the top slot at BaseballPhD. In addition, three of the four teams that advanced to the League Championship series numbered among Bukiet's five named winners. Both World Series contenders were also among the teams that, Bukiet said, should make it to the post-season. What is the likelihood of each team taking the series in a given number of games? Going into the series, the most likely outcome (23.2 percent) is for the Texas Rangers to win in five games. The Cardinals' best chance is 16 percent to win in seven games.

As to the winners of the Cy Young and Most Valuable Player awards, Bukiet's model analyzes the number of extra wins based on each player's performance in 2011 that would have been added to a team of otherwise average players (taking into account position played). "This year the results were unusual because the most deserving hitter and the most deserving pitcher in each league played for the same team," said Bukiet.

In the American League, the Cy Young Award should go to Detroit Tiger Justin Verlander, whose performance would have added 5.7 wins to an average team and the Most Valuable Player Award should go to his teammate (and runner-up for the MVP award in 2010) Miguel Cabrera, whose performance was worth a whopping 7.2 extra wins. Runners-up: Los Angeles Angel Jered Weaver, 4.2 extra wins; Toronto Blue Jay Jose Bautista, 7.0 extra wins).

In the National League, the Cy Young Award should go to Los Angeles Dodger Clayton Kershaw, whose performance would have added 4.6 wins to an average team and the Most Valuable Player Award should go to his teammate Matt Kemp, whose performance was worth 5.9 extra wins. (The runners up should be Philadelphia Phillies pitcher Roy Halladay with 4.0 extra wins and Milwaukee Brewer Ryan Braun with 5.6 extra wins, respectively). The methodology and results for post-season awards over the past 20 years using the model were published in the International Journal of Performance Analysis in Sports.

This is Bukiet's 11th year predicting the probability of each team winning each game played during the baseball season (posted on www.egrandslam.com) and predicting how teams should perform during the season. The results have compared favorably with experts.

HUNTSVILLE, TX -- In October 2011 the National Institute of Justice (NIJ) and the Forensic Science Foundation (FSF) funded a capstone project proposal in the Master of Forensic Science Program at Sam Houston State University to investigate the designer drugs known as "Bath Salts" (beta-keto-amphetamines or BKAs).

Designer drugs have posed a challenge for law enforcement and forensic scientists for decades, but more recently the proliferation of analogs has overwhelmed the scientific community, in large part due to the internet. The majority of BKA designer drugs are derived from cathinone, the active ingredient of Khat (Catha edulis), a plant native to Africa and the Middle East. Synthesis of these drugs is readily accomplished by clandestine chemists, making it an appealing drug for the designer drugs market.

The study will specifically address a number of central nervous system stimulants that are capable of producing powerful and unpredictable adrenergic and hallucinogenic effects. Many of these drugs were considered "legal highs" until the Drug Enforcement Administration placed several of them in Schedule I of the Federal Controlled Substance Act in an emergency scheduling action earlier this year. These drugs were available locally in gas stations, head shops and online until September 1 of this year, when The State of Texas enacted legislation to ban these substances. At least 24 other states have outlawed them, or have legislation pending due to intense media interest and publicity.

In the SHSU study, at least six of the most popular "bath salt" drugs will be investigated in biological samples. These include mephedrone, methylone, ethylone, butylone, MDPV and naphyrone. Mephedrone is one of the most common BKAs. It has a reputation of having similar but superior effects to MDMA (3,4 -methylenedioxymethamphetamine or Ecstasy). Street names for mephedrone include MCAT, meow meow, MMC hammer, 4 MMC, bubbles, meph, rush, drone and plant feeder. Mephedrone and the related BKAs are still relatively new, so few clinical, pharmacological or toxicological studies have been reported.

These drugs are easily identified in seized drug materials. The SHSU Regional Crime Laboratory (RCL), operated by the Criminal Justice Center, routinely receives items of evidence containing these drugs. Detection in toxicological (biological) evidence is far more challenging. Toxicologists are struggling to develop methodology to detect these drugs (and their metabolites) in biological specimens. Even less is understood with respect to the interpretation of results, and this has real consequences in terms of criminal casework and death investigation.

In order for these drugs to be studied and understood, analytical methodology will be developed for routine use. In the study, solid phase extraction (SPE) will be used to isolate the beta-keto amphetamines from biological matrices. Chromatographic and spectroscopic methods will be developed for instrumental analysis of the biological extracts. Chemical derivatization will be used to develop extracts that are amenable to common instrumental techniques that are used in a crime laboratory, such as gas chromatography/mass spectrometry (GC/MS).

The study, which will be conducted by MSFS student Kayla Ellefsen and Dr. Sarah Kerrigan at RCL, is an example of the MSFS student capstone experience, whereby students must successfully complete an intensive one-year research project with a faculty member. During the final phase of the study, the optimized procedure will be validated for use in actual casework at the lab.

Time zone database has new home after lawsuit (AP)

NEW YORK ? The organization in charge of the Internet's address system is taking over a database widely used by computers and websites to keep track of time zones around the world.

The transition to the Internet Corporation for Assigned Names and Numbers, or ICANN, comes a week after the database was abruptly removed from a U.S. government server because of a federal lawsuit claiming copyright infringement.

Without this database and others like it, computers would display Greenwich Mean Time, or the time in London when it isn't on summer time. People would have to manually calculate local time when they schedule meetings or book flights.

The Time Zone Database allows people to set clocks simply by choosing a city. Select New York, for example, and the computer will know that it is normally five hours behind London, but four hours during a brief period when the U.S. is still on summer time and Britain is not.

The database is updated more than a dozen times a year and is used by a range of computer operating systems including Apple Inc.'s Mac OS X, Oracle Corp., Unix and Linux, but not Microsoft Corp.'s Windows.

It's also used by several websites that tell people what the current time is around the world, or what time it will be in Sydney or Moscow next Tuesday at 8 p.m. in Los Angeles. Some non-Internet functions, such as calendar software, also incorporate the database.

Although those functions continued to work after the database disappeared from the government's server, computer systems couldn't get updates to reflect changes in time zones and in the duration of summer time.

Kim Davies, a technical manager at ICANN, said that because much of the Internet depends on the database, its management by ICANN is consistent with the organization's mission to maintain a stable Internet.

One of ICANN's main functions is to coordinate Internet domain names ? the suffixes such as ".com" and ".org" in Internet addresses. Those are key for allowing computers to find websites and route email.

ICANN has been in discussions for months about taking over the database with the impending retirement of its longtime coordinator. Arthur David Olson, an employee of the National Institutes of Health who volunteered as coordinator as a side project, began looking for a new home for the database in 2009.

ICANN accelerated those discussions and took over management Friday after the database was removed from NIH's server on Oct. 6, following a lawsuit over historical data used.

Astrology software company Astrolabe Inc. argues that Olson and another volunteer at University of California, Los Angeles should have paid royalties for including data from its software. The defendants have insisted that the data are in the public domain and not subject to copyright. Their employers were not named as defendants.

The federal lawsuit, filed Sept. 30 in Boston, does not affect current time zone information, which comes from tips sent by volunteers through an email list.

However, ICANN is keeping the historical information in the database.

"We are aware of the lawsuit," Davies said. "We believe it's important to continue the operation of the database. We'll deal with any legal matters as they arise."

Flood barriers hold firm in shielding Bangkok

(AP) ? Barriers protecting Bangkok from Thailand's worst floods in half a century held firm Sunday as the government said some water drenching provinces just north of the capital has begun receding.

That fueled hopes that Bangkok, a city of 9 million, could escape unharmed. But outside the capital, thousands of people remain displaced and hungry residents are struggling to survive in half-submerged towns. On Sunday, the military rescued terrified civilians from the rooftops of flooded buildings in the swamped city of Ayutthaya, one of the country's hardest-hit.

Bangkok has averted calamity so far thanks to a complex system of flood walls, canals, dikes and underground tunnels that are helping divert vast pools of runoff south into the Gulf of Thailand. But if any of the defenses fail, floodwaters could sweep through the tense city.

Ronnarong Wong-Ngern, a bare-chested construction worker in northwestern Bangkok, said residents there still worry that things could go wrong.

"I can't sleep at night," Ronnarong, 38, told The Associated Press as he stood beside a wall of sandbags built over a canal straddling one of the capital's northernmost borders. "Whenever it rains, all the men here get up and start adding new sandbags to these walls."

Seasonal rains that drench Southeast Asia annually have been extraordinarily severe this year, killing hundreds of people across the region. Thailand has been particularly affected. Nearly 300 people have died in the country so far, while more than 200 major highways and roads have been shut, along with the main rail lines to the north.

Despite widespread fears that disaster could touch Bangkok, the city has so far been mostly untouched. Heavy rains showered the capital for much of the day Sunday, but life was otherwise normal with shopping malls open and elevated trains crisscrossing the city.

Nationwide, the government says property damage and losses could total $3 billion dollars or more. The most affected provinces are just north of Bangkok, including Ayutthaya, a former capital which is home to ancient and treasured stone temples.

An Associated Press photographer who flew over Ayutthaya on Sunday in a Thai military helicopter saw the tops of historic pagodas rising out of the water like islands.

In Ayutthaya itself, troops in patrol boats rescued people who had taken refuge on rooftops after waters burst into the Bang Pa-In Industrial Estate.

"It's very scary, it's never been like this since I was born," one of them, Kwaikai Jeunglam, told Associated Press Television News. "Last night the water wasn't this high. Last night, it rose ... this morning, it rose a lot."

Speaking to reporters earlier Sunday, Agriculture Minister Theera Wongsamut expressed confidence the worst was over ? but stopped short of saying the threat to Bangkok had passed completely.

Theera said the largest mass of runoff water flowing south from the country's heavily inundated central plains had already passed through Bangkok's Chao Phraya river and into the sea, and water levels in river would rise no higher.

Floodwaters in the central provinces of Singburi, Angthong, and Ayutthaya had also begun to recede, Theera said.

A spokesman for the government's flood relief center, Wim Rungwattanajinda, said floodwaters have decreased in Nakhon Sawan province as well. Nakhon Sawan is also in central Thailand.

Another worry ? several days of higher-than-normal tides which have slowed runoff into the Chao Phraya ? has also eased. But similarly high tides are expected again at the end of the month.

Late Saturday, Bangkok Gov. Sukhumbhand Paribatra said he was worried about barriers on the northwest side of the capital, saying they were not as strong as in other parts of Bangkok and water could flood around them and into the city from the west. But on Sunday, he said the situation was still under control.

Associated Press journalists who traveled to that area Sunday found no serious flooding in the district bordering Nonthaburi and Nokhon Pathom provinces. Canals were not overflowing and although some residents were still reinforcing sandbag walls, few were worried.

Over the last few days, government officials have voiced increasing confidence the capital would survive without major damage. On Sunday, Prime Minister Yingluck Shinawatra echoed those sentiments again, saying "I believe Bangkok will be safe."

Yingluck spoke just after presiding over a ceremony in which an armada of more than 1,000 small boats stationed in dozens of spots on the Chao Phraya turned on their engines in an effort to help propel water down the river. It wasn't immediately clear what impact the effort would have.

Occupy Wall Street protests in China? Not for now, anyway.

Occupy Wall Street protests spread to four continents over the weekend, but China's major involvement was conspicuously absent.

As the ?Occupy Wall Street? movement spread to four continents over the weekend, guess which major world capital did not see any protesters?

Unsurprisingly, since unofficial public gatherings of any kind are taboo in China, Tiananmen Square was not teeming with anticapitalist demonstrators on Saturday.

Not that China might not be ripe for the spreading movement: A growing gulf between rich and poor here would make this fertile ground for the 99-percenters.

And the government knows it, which is why it is censoring any effort to organize protests in China. Type ?Occupy Beijing? into Internet search engines here and you get either completely irrelevant results, or references to protests in America, Japan, Singapore ? anywhere but China.

There is an ?Occupy Beijing? group on Facebook, but you can only get onto Facebook ? which is blocked by the Great Firewall ? if you have censorship-evading software, a comparative rarity in China. That makes the social networking site a poor organizing tool here.

A group of older men did mount a brief demonstration last week in a park in Zhengzhou, the capital of the central province of Henan, but it had a very different feel to it from the youthful tent cities that have sprung up in European capitals, to judge by a video that made it onto the Chinese web.

?Proletarians of the world, Unite!? read their red armbands, reminiscent of Mao?s days. ?At least 700 arrested in New York, democracy and liberty trampled on,? explained a flyer that organizers were handing out.

Even the video of this event proved too inflammatory for the Chinese authorities. It was taken down from the Sina.com website within a day or so.

A pop-up demonstration of some sort does seem to have taken place in the heartland of Chinese capitalism, to judge by photos linked to from the ?Occupy Shanghai? Facebook page. Pictures show a man in a panda mask in a number of different locations in Shanghai holding up a sign reading ?We are the 99 percent. We do not need greedy financial system. We need to move forward mankind? in Chinese and English.

Another man held up a similar sign in the university city of Nanjing. But those two men and their photographer accomplices appear to constitute the full extent of Chinese mainland public participation on the day ?Occupy Wall Street? went global.

The Uniform Electronic Legal Material Act Is Ready for Legislative ...

The Uniform Electronic Legal Material Act, referred to as UELMA, is ready for introduction into state legislatures.? It has undergone its final proofing and formatting process by the National Conference of Commissioners of Uniform State Laws (NCCUSL, or ULC) and has been posted on NCCUSL?s archival Website at the University of Pennsylvania, and is soon to come to NCCUSL?s official site.? The Act will be sent to the American Bar Association?s (ABA?s) House of Delegates for approval at the ABA Midyear Meeting in February, 2012 in New Orleans.

The UELMA addresses important issues in information management, providing sound guidance to states that are transitioning legal publications to digital formats.?? The Act is citizen-oriented, and leaves all issues concerning commercial publishing to state policy and contract law.?? Most importantly, the Act is outcomes-based, keeping it flexible in the face of changing technologies and evolving state practice.? A brief account of UELMA?s development and its main provisions is included in this posting.

The UELMA was drafted in response to a request from the American Association of Law Libraries (AALL), following the AALL?s 2007 National Summit on Authentication of Digital Legal Information. The purpose of the Summit was to bring national attention to the issues surrounding the rapid rise in the number of states publishing primary legal information resources electronically and, in some cases, cancelling print resources and publishing legal information only in electronic format.? Foremost among the issues were ensuring the trustworthiness of online legal resources? and preserving the electronic publications to provide for continuing accessibility.?? The drafting of a uniform act on these topics was one of the top recommendations of the Summit?s attendees.

The ULC agreed to consider the development of a uniform law and appointed a Study Committee for that purpose.? The Study Committee recommended that a law be developed and a Drafting Committee was charged with the task.? After two years of consideration, including several face-to-face meetings, conference calls, and circulation of numerous drafts by email, the UELMA was read to and debated for the second time at the Annual Meeting of NCCUSL in July 2011.? After more than six hours of floor consideration, the NCCUSL Committee of the Whole passed the draft act, sending it to a Vote of the States.? UELMA passed its final hurdle with a positive Vote of the States, gaining approval by a vote of 45-0 (with 1 abstention and 7 jurisdictions not voting).

The UELMA, as it passed the Conference, requires a state that publishes official versions of its legal information in electronic format to do three things:

1.? Authenticate the information, by providing a method to determine that the legal material is unaltered from the version published by the state officer or employee that publishes the material;
2.? Preserve the information; and
3.? Ensure public accessibility on a permanent basis.

At a minimum, legal material that is covered by the Act includes the most basic of state-level legal information resources, including the state constitution, session laws, codified laws or statutes, and state agency rules with the effect of law.? In recognition of potential separation of powers issues, the UELMA does not automatically include judicial or executive materials, leaving it to the enacting state to decide whether and how to include those resources.? States may choose to include court rules and decisions, state administrative agency decisions, executive official documents, or almost any other information resources they designate as legal material.

For each type of legal material, the state must name a state agency or official as the ?official publisher.?? The official publisher has the responsibility to authenticate, preserve, and provide access to the legal material. If legal material defined by the Act is published only electronically, that material must be designated ?official? and meet the requirements of the Act.? If there is a print version of the legal material, an official publisher may designate the online version ?official,? but the requirements of the Act to authenticate, preserve, and provide access must be met for the electronic version.

The requirements of the Act are not ended if the official electronic legal material is superseded, overruled, or otherwise ceases to be current law.?? Legal material does not lose its value even if it is no longer in effect.? Accordingly, once a source is designated as official, it continues to be covered by the provisions of the UELMA.? Historical sources must be preserved and made available.

The Act does not affect any relationships between an official state publisher and a commercial publisher, leaving those relationships to contract law.? Copyright laws are unaffected by the Act. The Act does not affect the rules of evidence; judges continue to make decisions about the admissibility of electronic evidence in their courtrooms.

The comments to the UELMA provide a great deal of background on the decisions and intent of the Drafting Committee.? In many instances, the comments offer guidance to legislators who will be asked to consider the UELMA for passage.? The comments are included with the Act on the University of Pennsylvania?s Biddle Law Library Website.

Some issues specific to one of the three parts of the Act (authentication, preservation, and public access) are as follows.? More information on these points can be found in the comments to the Act.

Authentication (Sections 5 and 6) :

The Drafting Committee considered a wide range of approaches to authentication before settling on a policy of presenting a technology-neutral, outcomes-based document, leaving the choice of method used to authenticate legal material up to the states.? This approach also leaves it to each state?s discretion to change methods, as necessary or desirable.? What is required is that the official publisher provides a method for the user to determine that the electronic record is unaltered from the one published by the official publisher.

By the terms of the Act, the authenticated electronic legal material will receive a presumption of accuracy, the same presumption that is created by publication of legal material in print form.? The burden of proving inaccuracy shifts to the party that disputes the accuracy of the electronic legal material.?? Electronic legal material from other states with substantially similar laws will receive the same presumption of accuracy.

Preservation (Section 7):

The Drafting Committee spent considerable time debating the preservation provisions.?? The biggest issues were finding a way to describe what legal material would be covered by a preservation requirement, and how legal material should be preserved.

The Drafting Committee decided that, ultimately, all legal material covered by the Act?s authentication provisions should also be subject to its preservation requirements.? This was stated simply as requiring preservation of legal material ?that is or was designated as official? under the Act.? This language requires that states preserve superseded or amended legal material, which retains importance despite its no longer being currently effective.? The comments to Section 7 make clear that the Drafting Committee intended the Act to cover not only the text of the law, but also the materials commonly published with the legal material.? This would mean that the lists of legislators and state officials typically published with session laws would be preserved, as would proposed or final state constitutional amendments, legislative resolutions, and any other type of information published with a legal material source.

The Drafting Committee decided to use an outcomes-based approach for the preservation requirements, similar to its approach to authentication.?? The ultimate outcome of preservation is that legal material may be preserved in an electronic format, in print, or by whatever method the state may choose in the future; consistent with an outcomes-based approach, state policy and preference dictate the preservation method.

If legal material is preserved electronically, the UELMA requires that the integrity of the record be ensured, including through backup and disaster recovery preparations, and that the continuing usability of the legal material is ensured.? Recent natural disasters in the U.S. have highlighted the importance of disaster recovery preparations.? Further, information that is preserved in an unusable format is of no value.? The comments make clear that migration to new formats or storage media will be required from time to time.

The comments also note that the Drafting Committee intended that legally significant formatting be preserved.? The complexity of presentation of some legal materials ? evident in indentations, italicization, and numbering of internal subdivisions, for example ? may indicate or explain legislative or regulatory intent.? Preservation should not change the meaning of the legal material, but rather should ensure that the legal material is capable of being authenticated.

The Act recognizes that states have decades, and in some instances centuries, of expertise in preserving print materials, and does not specify preservation requirements or outcomes if the state chooses to preserve legal material in print.? Nor does the Act impose a duty on an enacting state to retrospectively convert its print material to an electronic format.? If, however, the state chooses to digitize previously non-electronic legal material, and if that newly electronic legal material is designated as official, then the requirements of the Act must be met.? Publication of legal material in an official electronic version subsequent to the adoption of the UELMA, even if the same legal material was published previously in print, triggers the requirements of the Act.

Permanent Access (Section 8):

Citizens must be informed as to government actions if they are to participate effectively in their government.? Legal material is an essential information source for citizens to access to become informed.?? The UELMA recognizes this in requiring reasonable availability, on a permanent basis, of legal material, even that which is amended, repealed, or superseded.

The Drafting Committee debated conditions of access over several meetings, finally concluding that states already have long-term, relevant experience in making other materials available through archives, libraries, and state offices.? The enacting state has discretion to decide where, when, and how to provide access, including whether to charge fees for access.? Section 8?s requirement of permanent access does not require a state to provide unlimited access to its preserved legal information.? This drafting decision is consistent with the rest of the UELMA, which defers to state policy and practice in its other provisions.? Eventually, the Committee decided that the individual states could set their own requirements for access to legal material preserved under the Act, as long as the access is reasonable and in perpetuity.? For this reason, the Act does not address whether states can charge fees for access to preserved electronic legal material.

The Standards section of the Act (Section 9) directs official publishers of electronic legal material to consider developing standards and best practices as they choose and to implement methods for the authentication, preservation, and permanent access of electronic records.? The ?Guiding Principles to Be Considered in Developing a Future Instrument,? the best practices document of the Hague Conference on Private International Law, were important guidelines that were repeatedly consulted in the drafting process.

Throughout its deliberations, the Drafting Committee was advised and informed by a large number of advisors and observers who came from federal and state governments, commercial legal publishers and software vendors, and a number of interested organizations.? Two American Bar Association advisors brought knowledge of and experience with technologies to the drafting process.? The observers were very helpful in assisting the Committee in its understanding of the possible impacts of proposed sections of the Act.? In some instances, the observers were able to explain existing and emerging technologies that might be used to accomplish the Act?s specified outcomes.? The Committee watched technology demonstrations and investigated various authentication processes already in effect.? The drafting process was strengthened by the level of support and expertise the advisors and observers brought, but, in the end, the Act was entirely the Committee?s work.

By designating the Committee?s product a uniform law, the ULC recognized the importance of the topic and urged wide adoption of the Act.? The final step in the UELMA?s development will be its introduction into state legislatures.?? Bill sponsors are being identified, and the ULC anticipates the UELMA will be introduced in at least 8 states in January 2012, with the possibility of introduction in as many as 12.

The ULC has appointed an Enactment Committee for the UELMA to assist the larger ULC Legislative Committee with its charge to ?endeavor to secure the enactment of [uniform] legislation.??? The Enactment Committee prepares ?talking points? and summaries of the legislation, and works with individual legislatures, on occasion, to answer questions and further the introduction and approval of the Act.? Volunteers from several interested associations are also preparing to work towards the Act?s approval.? With strong support from the ULC and volunteers working on its behalf, by next summer the Uniform Act may itself become ?legal material? in one or more states.

Garage blaze displaces family and pets

INDIANAPOLIS (WISH) - A fire that began in an attached garage left $40,000 in damages at a far east side home, though everyone got out without injury, Indianapolis Fire Department officials say.

The fire in the 9100 block of East 13th Street tied up North Post Road for about an hour during morning rush hour. Firefighters responded around 7:19 a.m. to the home after the family smelled smoke and noticed the garage door from the interior of the house was hot.

It took firefighters 22 minutes to get the blaze under control.

A couple and their 9-year-old son lived in the home and will be staying with family. Firefighters and family also safely rescued the family?s two cats ? Calvin and Edward ? and a fish.

Family members told firefighters they weren?t sure what could have started the fire. They had no cars parked in the garage at the time.
